Terms of Service

epFidget Mobile Application

These Terms of Service (“Terms”) govern your use of the epFidget mobile application (the “App”) provided by EnrichPoint (“we,” “us,” or “our”). By installing or using the App, you agree to these Terms.

These Terms are an addendum to our site-wide Terms of Service, which cover the corporate relationship, account auth, dispute resolution, and other matters common to every EnrichPoint app. Where the two conflict on an epFidget-specific point, this document controls.

1. Who can use epFidget

The App is intended for use by individuals of any age, with the following constraints:

  • If you are creating a caregiver account, you must be at least 18 years old, or the age of majority in your jurisdiction.
  • If you are setting up an end-user profile for a child under 13, you must be the child's parent or legal guardian and provide verifiable parental consent (handled in-app at first setup).
  • You are responsible for the activity that occurs under any end-user profile you create.

2. Your Account

  • Caregivers must keep their account credentials secure. Do not share your password with anyone.
  • You are responsible for all activity that occurs under your account.
  • Notify us immediately at support@enrichpoint.com if you suspect unauthorized access.
  • We may suspend or terminate accounts that violate these Terms or that are used for fraud, abuse, or attempts to exploit the App.

3. License to Use the App

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for personal, non-commercial use. You may not:

  • Reverse-engineer, decompile, or disassemble the App.
  • Modify the App or create derivative works from it.
  • Resell, sublicense, rent, or lease the App or any content within it.
  • Use the App in any way that violates applicable law.

4. In-App Purchases (Add-on Packs)

The App is free to download and includes a starter set of toys and games. Additional add-on packs (themes, toys, mini-games) are available for purchase.

How purchases work

  • Add-on purchases are processed through Stripe. EnrichPoint is the merchant of record.
  • Prices are displayed in US Dollars unless otherwise noted. Local taxes may apply.
  • Once purchased, an add-on is associated with the caregiver's account and unlocked for the end-user profile selected at purchase time.
  • One-time purchases unlock the add-on permanently for that end user. Recurring purchases (if any) unlock the add-on for the duration of the active subscription.

Refunds

  • One-time add-on purchases are non-refundable except where required by law.
  • If you experience a billing issue, contact support@enrichpoint.com within 30 days of purchase. We may issue a refund at our discretion, especially for purchases made within 48 hours or that did not unlock the intended content due to a technical issue on our side.
  • Refund handling for purchases made through the Apple App Store or Google Play, when those flows are available, follows the respective platform's refund policy.

5. Content and Intellectual Property

  • The App, its visual design, animations, sound effects, code, and all add-on content remain the property of EnrichPoint (or its licensors).
  • Purchasing an add-on grants you a personal-use license to that content; it does not transfer ownership of the content itself.
  • The EnrichPoint and epFidget names and logos are trademarks of EnrichPoint.

6. Acceptable Use

You agree not to:

  • Attempt to gain unauthorized access to other users' accounts or end-user profiles.
  • Use automated tools to scrape, copy, or interact with the App at scale.
  • Interfere with the App's normal operation, including denial-of-service attempts or excessive load.
  • Attempt to circumvent paywalls or unlock add-ons without purchase.

7. Service Availability

We aim to keep the App available, but we make no guarantee of uninterrupted service. Some features (push notifications, cloud-synced settings, add-on purchase verification) require an internet connection and depend on third-party infrastructure (Firebase, Stripe). We are not liable for downtime caused by those providers.

8. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the App will meet your requirements, be uninterrupted, secure, or error-free, or that defects will be corrected.

9. Limitation of Liability

To the maximum extent permitted by law, EnrichPoint will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability for any claim arising under these Terms is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim, or USD $50, whichever is greater.

10. Termination

You may stop using the App at any time. To delete your account, visit /epfidget/delete-account. We may suspend or terminate accounts that violate these Terms; in such cases unused add-on purchases are not refundable except where required by law.

11. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the “Effective date” above and announce material changes in the App or on this page. Continued use of the App after the new effective date constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which EnrichPoint is registered, without regard to its conflict-of-laws principles. Any dispute will be resolved in the manner described in the site-wide Terms of Service.
